Pachter Factor Questions November 2019

We have just two rounds of Pachter Factor left to shoot before the end of 2019. So this is one of your last chances to ask him a question before we turn the page to 2020. As usual, ask questions that are based on current events, but also some questions that will be interesting a few weeks from now. We also encourage you to ask questions that stray outside of games as they're often some of the best segments in the show.

Also remember Black Friday will be happening while these episodes are running.

Thanks as always for participating. Without you there is no Pachter Factor!

Pachter Factor Questions November 2019

Hi Pach, Jedi Fallen Order can be pre-ordered on Steam (but runs on EA's Origin). I thought EA stopped cross-selling on Steam sometime after Mass Effect 2. What has made them come back?

Another one: What do you think of the latest Ubisoft ER debacle?

Hello Pach! Enjoying your show very much, really appreciate you taking the time to school all these fellow babies! With the upcoming new generation of consoles, games’ graphics will reach new limits. How will this affect the AAA gaming landscape in terms of development time, costs and risk taking by developers? Will game prices increase? $70?$80? $100?! Will the different streaming subscription services (game pass, PS now) help to create a new revenue stream to alíviate the expected cost increase in gaming development? Thanks and best regards!

Hey Pach! I'm an old GT cat who recently discovered that the Pachter Factor is still up and running. It's good to see you, brother. Playtonic, a studio composed of ex-Rare devs, has released two Yooka-Laylee games that are commonly considered "Rare clones". Surely there's personal animosity at play. Given this, why does Microsoft support Playtonic titles? And do you take any similar bad-blood into account when organising your E3 shindig?

Hi Pach, for companies that aren't exclusively about gaming (Microsoft has Windows, Google has Big Data, Sony has multiple electronics, etc) what are the sorts of impacts that the successes and failures of their gaming consoles, games, etc have on the rest of the business and vice versa?

How do you think Microsoft struck a deal with Take Two on The Outer Worlds with Game Pass?

Hi Pach! When a publisher or larger developer buys a smaller studio, what are the typical contract provisions? Is there an automatic transfer of IP rights? Do key team member sign non-competes or promise to stay on for a minimum amount of time? Or are there other common provisions we don’t see from the outside?

Hey Pach. We’ve had a lot of Nintendo questions lately, so here’s one more. Assuming that cloud gaming continues to accelerate and subscription services like Apple Arcade are at least moderately successful, how do you envision Nintendo competing long-term with these challengers, if at all. I can’t imagine Nintendo creating their own cloud streaming service, for example. Congrats on your StarMine award!

Mr. pach, Well it's the end of this generation of consoles for ps4 and xbox one. So going forward do the sales truly matter now since they should be focused on the next generation sales? If they do matter what about the sales, what are the looking for, is the game sales of hardware sales.

Hi Pach, if you had to guess, how many copies do you think EA will need to sell of Star Wars Jedi: Fallen Order in order to be happy / consider it a success? I get the impression that they really need it to make a BIG splash given the amount of money that must have been spent on the Star Wars licence (and the lack of other games produced). Even if they sell through around 5 million could that still be a disappointment?

Hi Pach! You've had long-term concerns around Netflix for quite some time due to their debt load and growth plan. Are there any gaming companies that you see going down a similarly troubling path?

Recently news has come out that the next generation of consoles for Xbox and Playstation are each going to have integrated cameras. It seems like an odd coincidence that they both would have integrated cameras when Xbox stopped pushing Kinect and it's camera technology. In recent competing brands have produced similar hardware like Wii Controls, Kinect and Playstation Move and when I was young the Sega Menacer and Super Scope 6. How do competing companies release similar products so close to each other if they don’t know what the other is developing?

Why would you say "I don't think the ESA breach was a big deal at all"? A company demonstrating its complete lack of data protection by leaving personal data just sitting on an open website is a major breach of trust.

Hey Pach! With all the hullabaloo about Blizzard going on right now re: China and Hearthstone, I think it raises an interesting question related to the responsibilities of companies to their shareholders. Standard 501(c)(3) corporations generally require the business to make as much money as possible, leading to things like the Blizzard situation, so as a fellow lawyer, where do you stand on Benefit Corps? Do you believe they have value? How would a switch from old-style corporations to a more socially conscious corporation impact the gaming industry, and American society as a whole?
