As an economist that looked at mergers, it hurts me every time you guys talk about the Activision deal lol :p. Patcher was quite accurate overall. It has nothing to do with the potentiality of creating such and such and everything to do with current market shares. In ways it is indirectly related to owning popular IPs as this is related to market shares. If company owns 100% of shooters it doesn't matter that a new studio could create one. What matter is now, and what is the market exactly: shooters or war shooters or WWII shooters... etc. If the market definition is more precise, the share is higher and merge might become an issue. You might disagree with how it goes but this is mostly how it is regardless of the industries. If everything was based on what could be achieve it would be an infinite discussion, but, in my opinion the court should not consider what can be achieve... Way too much interpretation for lawyers...
