Long story short since I don't want to feed the drama even more, I had enough of it.
The motion sent against us was referred to a Magistrate Judge to make a report and recommendation to a District Judge on how to rule on it.
The Magistrate Judge recommends dismissal of the lawsuit based on lack of personal jurisdiction.
